Imagineer Triumphs: MEDABOTS Trademark Battle Ends in Victory

, the owners of the MEDABOTS Series, has announced they have retained ownership of the MEDABOTS Trademark after a nearly seven year long battle.

The trademark was called into question by a Spanish Lawsuit issued by Kevin Comadrán de Frutos who sued the company over the use of the name. Comadrán registered the trademark for himself back in 2018 to release his own video game, and has caused issues for Imagineer and the long running series ever since.

In Imagineer's announcement regarding the ruling, they had this to say:

The decision announced in the press release "Notice of the victory judgment of the Spanish lawsuit (second instance) on the trademark of MEDABOTS" was made by the other party (Kevin Comadrán de Frutos), but the Supreme Court of Spain rejected the appeal on October 29th, and we are pleased to announce that the judgment of the entire victory of the Company has been finalized.

We will continue to strive to protect legitimate intellectual property rights and develop a sound content business. 


This has been an on-going battle for Imagineer, with them previously providing the following update back in September of 2023: 

We are pleased to announce that we have received an appeal on February 23rd, and we have received a decision to appeal in the press release "Notice of the victory judgment of the Spanish case (first instance) regarding the Spanish lawsuit (first instance) regarding the trademark of "MEDABOTS" of the Company."

Kevin Comadrán de Frutos (hereinafter referred to as "Mr. Comadrán") on May 26, 2020, is pleased to announce that the Company has adopted. 17847161, EU Trademark Registration No. 17847161 (hereinafter referred to as "EU Trademarks") Alicante Commercial Court in Spain filed a lawsuit seeking the discontinuation of the sale of video games, etc., but on November 29th, the court ordered the cancellation of the EU trademark and dismissed Mr. Comadran's claim.

On September 15th, the Alicante Court of Appeal dismissed his appeal and recognized the decision to recognize that the unauthorized use of the title of the video game "MEDABOTS" constitutes an infringement of our intellectual property rights and that the ownership of the EU trademark belongs to the Company.

Regarding the above judgment, there is a possibility that an appeal to the Supreme Court will be made under the Procedural Law, but we will inform you in a press release when the judgment is finalized. Even if an appeal is made in the future to the above judgment, the Company will continue to respond to the determination of the above judgment.

 

While this was a victory for Imagineer, it wasn't until today (11/12/2025) that the decision was made final to allow the company to retain the rights to the name, and continue releasing MEDABOT titles.
